Exempt & Complying Development

State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (the Codes SEPP) specifies exempt development.  It has state-wide application and commenced on 27 February 2009.

A Section 10.7 Certificate under the Environmental Planning and Assessment Act, 1979 will confirm whether complying development can be carried out on all of the land, part of the land or none of the land. If complying development cannot be carried out, the reason will be specified. If Council does not have adequate information to determine whether or not complying development can take place, advice will be provided to this effect in the certificate. Bellingen Local Environmental Plan 2010 was gazetted on 6th August 2010 and this specifies additional categories of development as “exempt” in Schedule 2 of the document.

These development categories are not covered by the Codes SEPP, but are considered relevant and necessary within Bellingen Shire.
